Most parents will do most anything to protect their children. This rings true with estate planning as well. We all want to leave enough money in the bank to make our kids a comfortable life and hope we are around long enough to see them grown with kids of their own. Life is unpredictable, however, so it is important to have safeguards in place for our children now…just in case. Through drafting a Last Will and Testament, parents can pick who they would want appointed to raise their children if they themselves can not. Children can not inherit money, property or much of anything until they are 19 in Alabama. To avoid a lengthy and expensive process of establishing a conservatorship (Court babysitting per se) to hold the money and property until the children are 19, the testamentary trust can be used to protect the child’s inheritance and to control when the child will receive his or her share. Through the use of the Last Will and Testament with the testamentary trust, children and your assets for them can be protected.
